§ 1.

[General provisions]
  1. This privacy policy sets out the rules for the processing of personal data collected via the website available at swenergia.pl.
  2. The words used below mean:

a) Administrator – SWE Sp. z o. o., ul. Wiosny Ludów 1, 44-321 Marklowice, NIP: 2060002334, REGON: 243176104

b) Website – website located at swenergia.pl;

c) User – any natural person using the Website, visiting it or otherwise providing the Administrator with their personal data via the Internet.

§2.

[Personal data protection]
  1. The administrator is the controller of the processed personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/ 46/EC (“GDPR”).
  2. The Administrator processes personal data within the limits and cases specified by law, in accordance with the provisions of law, in particular the GDPR. Personal data is collected in connection with the User’s use of the Website or other forms of remote communication with the Administrator, and may include:

a) identification data collected via any contact or application forms, processed pursuant to Art. 6 section 1 letter b) General Data Protection Regulation, in order to perform contracts concluded with the data subject or to take pre-contractual activities at the request of that person, including the provision of legal advisory, audit and training services, for the entire duration of these contracts or until the time of closing the inquiry handling process if no contract was concluded in connection with the inquiry;

b) data collected automatically in connection with the User’s use of the Website – Website log data, processed pursuant to the provisions of Art. 6 section 1 letter f) General Data Protection Regulation, in order for the Administrator to pursue legally justified own interests consisting in conducting statistical activities and development work, for the period necessary to achieve the purposes of their processing or until the User reports an effective objection to the processing of personal data in this respect;

The Administrator reserves the right to process personal data for a period longer than indicated in section. 1 – 2 above, pursuant to the provisions of Art. 6 section 1 letter f) General Data Protection Regulation, in order for the Administrator to pursue legally justified own interests consisting in pursuing claims against the User and third parties in connection with the User’s use of the Website or protection against such claims, until these claims expire or become statute-barred.
  2. The User’s personal data may be transferred to the necessary extent to data recipients – entities providing support services to the Administrator, as part of the relationship of entrusting the processing of personal data, in connection with the use of services provided by these entities.
  3. Each person affected by personal data processed by the Administrator is entitled, subject to legal exceptions, including the GDPR, to request access to personal data, the right to rectify, delete, limit processing, transfer data, as well as the right to object. towards processing carried out pursuant to Art. 6 section 1 letter f) GDPR and to submit a complaint to the President of the Personal Data Protection Office.
  4. A person who has consented to the processing of data has the right to withdraw this consent at any time. However, this does not affect the lawfulness of data processing prior to withdrawal of consent.
  5. Providing the data specified in section 2 is voluntary, but may be necessary to provide the services described there or for the Administrator to perform the activities described there.

§3.

[Security of personal data]
  1. The User’s personal data are processed in appropriately secured information storage centers to which only authorized persons have access.
  2. The Administrator processes Users’ personal data in compliance with all legal and technical requirements imposed on it by generally applicable provisions on the protection of personal data.
  3. The User’s personal data will be kept confidential within the limits set out in this policy and generally applicable laws.

[Cookies]
  1. The administrator uses cookies, among others: in order to adapt the Website to the needs of Users and for statistical purposes. You can change cookie settings in your web browser. Failure to change these settings constitutes acceptance of the cookies used here.
  2. According to the practice of most websites before we echo HTTP requests sent to the server (server logs).
  3. The collected logs are stored for a period of 12 months from the date of their collection or until the User files an effective objection to data processing in this respect, and are processed as auxiliary material used to administer the Website. The information contained therein is not disclosed to anyone other than persons authorized to administer the Website. Based on log files, statistics can be generated to help with administration. Aggregate summaries in the form of such statistics do not contain any features identifying persons visiting the Website.

The processing of the data referred to above takes place in relation to log data on the basis of the provisions of Art. 6 section 1 letter f) GDPR, i.e. in order to implement the legitimate interest of the Administrator, including administering the Website and keeping statistics, as well as in connection with granting consent, pursuant to the provisions of Art. 6 section 1 letter a) GDPR, in relation to data collected using cookies. The consent given by the User may be withdrawn at any time, provided that this will not affect the processing taking place before its withdrawal.
  5. Stored cookies do not in any way enable the identification of the person visiting this website. Each cookie has an expiry date defined by the creator, after which it is deleted from the browser’s memory.
  6. The website stores only information about the language selection in which the website content is presented and whether the privacy policy information bar is hidden.
  7. The website also collects statistical information and information that helps us understand how Users use this website, which allows us to improve its structure and content. For this purpose, the Google Analytics mechanism was used, which stores only information in cookies that allows for a clear distinction between computer systems.
